
Membership Waiver
In consideration for the use of the facilities and participation in programs and activities offered by the Mount Desert Island YMCA ("The Y"), the undersigned agrees to the following terms: 1. Acknowledgment and Assumption of Risk I, for myself and any minor children included in my membership, acknowledge and understand that there are inherent risks and dangers associated with the use of the Y's facilities, premises, and participation in its programs and activities. These risks include, but are not limited to: Risks associated with physical exercise and use of equipment, including unforeseen equipment malfunctions. Accidental contact with other participants. Slipping and/or falling in the building, on the premises, or in the surrounding areas. Injuries arising from supervised or unsupervised use of the facilities and equipment. Risks related to swimming, water activities, and participation in sports programs. Theft or damage to personal property. All risks of injury, death, or property damage, whether known or unknown, associated with participation in these activities, are voluntarily assumed. 2. Waiver, Release, and Indemnity The Y and its affiliates ("the Releasees") are released from any liability for loss, damage, or injury, including death, sustained while using the Y's facilities or participating in activities, including those of minor children on the membership. The Releasees are indemnified for any costs incurred due to presence at the Y. This release applies regardless of supervision or how the injury/damage occurs. 3. Nationwide Membership Program (if applicable) By participating in the YMCA nationwide membership program I agree to release the National Council of Young Men's Christian Associations of the United States of America, and its independent and autonomous members associations in the United States and Puerto Rice from claims of negligence for bodily injury or death in connection with the use of YMCA facilities, and from any liability for other claims, including loss of property to the fullest extent of the law. Those participating in the Nationwide Membership program agree to follow the rules of any Y visited and release the National Council of YMCAs and its associations from negligence claims for injury or death related to using facilities and programs. 4. Sex Offender Screening The Y conducts sex offender screenings on all members and program participants, and may terminate membership and access if there is a match to the registry. 5. Photo and Video Release Unless objected to in writing, the Y is permitted to use photos or videos for promotional purposes. 6. Membership Policies The Y's membership policies, guidelines, and code of conduct must be followed, and these should be shared with any minor children in the membership.
Code of Conduct
We expect individuals using the YMCA to act maturely, behave responsibly, and respect the rights and dignity of others. Our Code of Conduct outlines prohibited actions. The actions listed below are not an all-inclusive list of behaviors considered inappropriate in our facilities and/or programs. Using or possessing alcohol or illegal drugs on Y property, in Y vehicles, or at Y-sponsored programs Smoking and/or vaping on YMCA property - the Y and its property is a smoke-free environment Carrying or concealing a weapon Harassment or intimidation by words, gestures, body language, or any type of menacing behavior Physical contact with another person in an angry, aggressive, or threatening way Verbally abusive behavior, including angry or vulgar language, swearing, name-calling, or shouting Sexually explicit conversation or behavior; any sexual contact with another person Theft or behavior that results in the destruction or loss of property Loitering within or on the grounds of the Y 7. Severability If any part of this agreement is invalid, the rest remains in effect. 8. Governing Law This agreement is governed by the laws of Maine.
Program Participation Waiver
The Mount Desert Island YMCA is committed to providing a safe and welcoming environment for all members and guests. To promote safety and comfort for all, all individuals are asked to act appropriately at all times when in our facility or participating in our programs. We expect persons using the YMCA to act maturely, to behave responsibly, and to respect the rights and dignity of others. Our Code of Conduct guidelines below outline prohibited actions. The actions listed below are not an all-inclusive list of behaviors considered inappropriate in our facilities and/or programs. Using or possessing alcohol or illegal drugs on Y property, in Y vehicles, or at Y-sponsored programs Smoking and/or vaping on YMCA property - the Y and its property is a smoke-free environment Carrying or concealing a weapon or any device or object that may be used as a weapon Harassment or intimidation by words, gestures, body language, or any type of menacing behavior Physical contact with another person in an angry, aggressive, or threatening way Verbally abusive behavior, including angry or vulgar language, swearing, name-calling, or shouting Sexually explicit conversation or behavior; any sexual contact with another person Theft or behavior that results in the destruction or loss of property Loitering within or on the grounds of the Y
Bullying and Conflict Resolution
Bullying is any unwanted behavior that involves a power imbalance. Here at the Y, our goal is to stop bullying. We encourage our participants, parents, and staff to be Upstanders. An Upstander is one who recognizes when something is wrong and acts to make it right. If there is disclosure, discovery, or suspicion of bullying, we will handle it on a case-by-case basis with care. At the Y, we are building a caring, respectful, honest, and responsible community for all; the safety of our program participants is our main concern. We define conflict as a disagreement or argument in which both sides express their views, and there is an equal power balance. Conflict can be constructive if managed in the right way. We will identify and resolve conflicts in a healthy and proactive fashion. The conflict resolution skills we learn and practice will make a positive impact on our Y programs and on everyone's future.
Emergency Care
I grant authorization and consent for myself or my child/ward to the staff of the Y to administer general first aid treatment for any minor injuries or illnesses experienced. I understand there is some risk involved in all physical activities. If the injury or illness is life threatening or in need of emergency treatment, I authorize the Y staff to summon any professional emergency personnel to attend, transport, and treat and to issue consent for any X-ray, anesthetic, blood transfusion, medication, or other medical diagnosis, treatment, or hospital care deemed advisable by, and to be rendered under the general supervision of, any licensed physician, surgeon, dentist, hospital, or other medical professional or institution duly licensed to practice in the state in which such treatment is to occur. I agree to assume financial responsibility for all expenses of such care. It is understood that this authorization is given in advance of any such medical treatment, but is given to provide authority and power on the part of the designated MDI YMCA staff in the exercise of their best judgment upon the advice of any such medical or emergency personnel. The Y and its affiliates ("the Releasees") are released from any liability for loss, damage, or injury, including death, sustained while using the Y's facilities or participating in activities, including those of minor children on the membership. This release applies regardless of supervision or how the injury/damage occurs.
Payment Policies
Outstanding Payments - I may not register a participant for a new program until outstanding balances due on past programs at the MDI YMCA are paid. Returned Customer Payments - The Y will attempt to collect all returned outstanding payments until they are paid in full. All returned drafts or checks are subject to a collection fee. If your draft is returned, it will be resubmitted on the Y’s next draft date. Your financial institution may charge a fee for each unsuccessful attempt to process a draft. The Y will not reimburse bank fees due to draft attempts. If credit or debit card payments are rejected, it is your responsibility to contact the Y with updated payment information. Cancellations - In order to cancel a youth child care program, the Y must receive a written notice to stop the automatic program payments. Deposits are non-refundable. If you cancel a non-child care program, please see or contact the front desk staff to see if you are eligible for a partial refund. Payments via Bank Drafts - Your automatic withdrawal date will be the 3rd of each month. IMPORTANT: If your draft date falls on a weekend or bank holiday, you will be drafted the following business day. Third Party Payment Agreement- If you have a Third Party Payment Agreement in place related to a registration, you understand that such agreement is in addition to, and not in replacement of, any obligations you have under these YMCA policies, including any obligations to pay all amounts in connection with the program or the loss of 3rd party funding. You need to cooperate and communicate with the Y so we can make sure we have all the necessary information to direct bill the 3rd party. Child Care Pricing - Afterschool Care, Summer Camp, and Preschool pricing is by the week. Payment is due and will be scheduled for 3 days before the start of care, the Friday before the program begins. Refunds - If a refund is due, and agreed upon by Y staff, the refund will first be applied to any past due balances (program fees, membership dues, etc.). All refunds are issued to the original form of payment. Refunds are issued within two weeks of the cancellation date. Not attending a program does not entitle you to a refund. When you enroll in a program, you are reserving space, time, and staffing whether or not you attend the program.
Consent to Treat Youth
Permission to Treat/ Informed Consent By signing this agreement, my child/ren is/are qualified physically, mentally, and emotionally for YMCA programming and understand there is some risk involved in all physical activities. I agree to place my child in the care of the YMCA staff, subject to its program policies. I permit him/her/them to take part in all activities and field trips. In the event the responsible parents/guardians cannot be reached, I give my permission to the medical personnel selected by the camp to transport, hospitalize, secure proper treatment for, and to order injections, x-rays, routine tests, anesthesia, or surgery for my child and to release any records necessary for treatment, referral, billing, and insurance purposes. I give my child permission to participate in swimming at the Y pool under the supervision of a certified lifeguard and program staff for free swim and/or swim lessons under the additional supervision of a certified swim lesson instructor. Or on a field trip to a natural body of water under the supervision of a lifeguard and program staff.
Preschool Agreements
In registering for this program, I understand that I'm agreeing to the following: I understand that all cancellations, other than for medical reasons, require written notice. (Refer to Parent Handbook for more details) I permit my child to participate in all activities for his/her age group. I permit my child to be transported by the Y to participate in activities. I understand the certain hazards of participating in swimming/water activities, and I assume the risk of possible injury in my child's participation in these activities. I hereby waive and hold harmless the Y, its agents, and employees from any liability regarding my child participating in swimming/water-related activities. I will keep the staff updated on the child care profile of any progress in my child’s swim ability. I recognize that the Y is not responsible for lost, stolen, or damaged personal property.
Immunization Agreement
A current immunization record is required before the beginning of Y childcare and camp programs. The Maine Department of Health and Human Services requires (4) DTap, (3) Polio, (1) MMR, and (1) Varicella before children enter a licensed Pre-K setting. You may drop it off at the Y, email it to our Director of Youth Programming at youthprograms@mdiymca.org, or fax it to us at (207)288-3019. By signing this agreement, "I have read and understand this requirement and agree to get records of all immunizations to the MDI YMCA BEFORE the child comes to the YMCA for a childcare and/or camp program, and I will get updated records as requested and when there are new immunizations to share. The Y reserves the right to not accept the child into programming without current records.
Extended Access Waiver/Agreement
The Y has a strict code of conduct based on our values of honesty, respect, caring, and responsibility. If a member fails to abide by the policies established or follow member conduct guidelines, their extended hours access and their membership will be revoked without refund. Violations of the code of conduct, including trespassing, theft, and other crimes, may lead to prosecution. Members with Extended Hours access use the Y Wellness Center at their own risk. Extended hours access is limited to members in good standing aged 18 and older. I am not allowed to give access to anyone without an Extended Hours membership to the Mount Desert Island YMCA facility. Doing so will result in the immediate cancellation of my membership, without refund. I understand that if I allow access to anyone without an Extended Hours membership, it will be considered trespassing, and legal action may be taken. The Y highly recommends that I have an adult workout partner, who also has Extended Hours access, to accompany me while using the Y during unstaffed hours. The Mount Desert Island YMCA uses 24-hour video surveillance access to our center, but does not provide staffing assistance for emergencies. If I need emergency assistance, I can use the emergency phone in the fitness center to call 911. I will wipe down all wellness equipment with a cloth and spray bottle disinfectant or disinfectant wipes before and after use. I must provide the Y with contact information and changes (address, phone, and email) as they occur. If I wish to terminate my after-hours membership add-on, I must do so with the front desk or through the form on the website mdiymca.org/cancel The following are prohibited during Extended Hours access. Large gym bags. Selling merchandise and/or products of any kind. Any physical and/or verbal confrontations. Use of areas in the facilities that are closed/gated. Extended hours access members must use their own access code for entry. In the event that your access code does not work, please call the Y during normal operating hours for assistance. Please use the same entrance and exit location when enjoying the Extended house access benefit. Emergency exits are available to use in the event of an emergency only. I understand that I will be charged $10/month as a membership add-on to my YMCA membership. During non-business hours on heavy snow days, snow removal will not be in place until staff are present (later if there is a delay in operating hours). Members with Extended hours access will be notified of closures for inclement weather that result in unsafe conditions via the Y text alerts, website, and social media feeds. If there is a loss of power in the building, please immediately follow the emergency exit signs and leave the building.
Extended Access Waiver/Agreement
Required for entry without parents/guardians for youth in grades 4-8. Children under grade 4 are not allowed into the Y without direct supervision. Purpose of this Agreement: Provide a healthy, safe, and FUN community center for all! Help children feel good about themselves. Help children learn responsibility and accountability. Teach children honesty and how to model good behavior. Teach children to respect and care for others and their environment. I understand that the following behaviors are unacceptable: a. Bullying or endangering the health or safety of myself and others. b. Damaging or stealing from the site, facilities, or others’ personal property. c. Disrupting staff, other Y members, and guests. d. Swearing and using inappropriate language in a community center. e. Refusing to follow behavior guidelines, corrective actions, and rules. f. I will not take pictures or record anyone anywhere at the Y. ENTRANCE / LOBBY I will not run, dribble balls, or block walkways in the lobby for the safety of others. I understand that food and drink are only allowed in the lobby. I understand that phones and other electronics can only be used in the first-floor lobby. GYM I will wear clean, appropriate footwear. I understand that food and drinks are NOT allowed in the gym. I will use the equipment as it is intended to be used. I will clean up after myself. I will not throw/kick balls onto the track. If a ball goes onto the track, I will immediately retrieve it. I understand that nothing should be dropped from the track to the gym; doing so is dangerous. TRACK I will wear clean, appropriate footwear. I understand it is for fitness activities and not for hanging out. I will only go onto the track to exercise and will follow that day's one-way flow. I know that bikes, balls, food, or drink are not allowed. I will be aware of and polite to others while exercising, only touching or being on fitness equipment if I am using it to exercise. LOCKER ROOM(S) AND SHOWERS I know that the locker rooms are not a place to hang out. I know I can not use a cell phone or eat food in the locker room. I know that I am not allowed to climb on the lockers, as that is dangerous. FITNESS CENTER If I’m in grades 6-8, I understand I will have to complete “Fit Kids” to enter the fitness center or be under the direct supervision of an adult; Otherwise, the fitness center is for high school students and older. I will use the equipment as it is intended. I will be aware of and polite to others while exercising. If any staff member has to speak with me about my behavior, a note will be put on my membership record. If I get two notes in a week, my parents will be contacted, and I will not be allowed at the Y for a week to hang out. If I am registered for a program during a suspension, I may attend but must report directly to the program. I understand that if I am repeatedly asked to change my behavior and I do not, my membership, which is a privilege, may be suspended or terminated.
